Land Titles Registration

1. Can the instrument form be filled-up by using blue ink or ballpoint pen?

Instrument form can only be completed with the use of indelible ink black or blue-black in accordance with the provisions of the Tenth Schedule to the Land Code.

2. Should the attestation column be completed if there is already a common seal?

The attestation column does not need to be completed if there is a common seal on the instruments form. But instruments with a common seal must be accompanied by a statement under section 210 of the National Land Code.

3. Can changes be made in the instruments form?

Changes can be made in the instruments form provided that all changes must be initialed.

4. Can the attestation for instruments related to Melaka Customary Land (MCL) be made by an advocate or solicitor?

Attestation of Melaka Customary Land (MCL) can only be done by the District Land Administrator only.

5. Does Land Titles Registration Unit accept an incomplete submission?

Incomplete submission is accepted, but the registration can only be completed once the necessary documents / queried been accepted by the Land Office.

6. Who can or eligible to apply for removal of private caveats?

Only the owner or registered stakeholders can make an application.

7. How to apply for removal of private caveats?

The application can be made to Registrar under Section 326 National Land Code using Form 19H or through court order based on Section 327 KTN.

8. Can the dealing be carried out if the land tax for the current year has not been cleared?

The land tax for the current year must be cleared before any dealing can be carried out.

9. Can all matter in Land Titles Registration Unit paid by cheque?

Payment can be made by cheque for transactions involving an amount of RM300.00 and above.

10. How to fill Form 14A (Form of Transfer)?

Each transaction must use the relevant form, as well as ways of filling it. While filling the form, the provisions contained in Section 43 and Schedule 10 of the NLC be observed. The instrument duly completed must be signed by the owner or person in connection itself and for cases involving companies and corporate bodies, the instrument must be signed by an authorized officer under the constitution or laws of the corporate bodies or related company.  

All instruments held by an individual shall be attested by officials as stated in the Schedule 5, KTN and in accordance to the companies and corporate bodies law.  

All instruments have been refined enough to be stamped by the Stamp Act 1949 and submitted to the relevant Land Office for registration. In addition, the accompanying documents must be submitted and the fees 'fees' are set to be discussed.

11. What is a Private Caveat and what form is used to apply for entry of a private caveat?

A private caveat’s purpose is to prohibit any dealings relating to land and may be entered at the instance of any person or body specified in section 323 of the National Land Code. A private caveat may be entered using Form 19B.

Private Caveat application must be made using Form 19B and be completed and attested and stating the characteristics of either claim caveat to be entered in accordance with the land or interest in Section 323 (2). Payments as prescribed and declaration letter must be attached.

12. What should be done if my original title goes missing or is damaged?

The proprietor may apply for a replacement title and submit the documents required in the checklist such as:

  • Police report (if any);
  • Statutory Declaration in respect of the loss of title (made by proprietor or any person or body claiming through the proprietor). The Statutory Declaration must contain the details of the lost title such as the title number, lot number, mukim/town/land name, and the district.
  • The proprietor should submit the documents required by the checklist provided together with the payment of RM240.00 for every title.
